The business of renting is a good idea, but it’s become a nightmare when your renter will not able to pay your rent on time. As a landlord, when your rent is getting day by day by renter/tenant side it’s become frustrating. It's become more frustrating when your tenant will refuse to pay rent over a long period and you are waiting for rent when you are very needy to get money. At that time you lost your patience and ready to create an issue with your renter and environment become heated with the arguments, at least you have to visit court or take help from the law. So there some idea’s which may helpful to get the right renter and avoid the issues related to renting:
Documents and Payment Records
Whenever you are getting a new renter, you have to verify all the documents but assure that have you check the previous payment records? Because several time landlords forget to check the pervious payment records or renters will success take into their confidence that they will pay the rent on time, but it is not happening after some time. So it is good to check the payment records and documents, may be they are not good to pay rent on time. Many times landlords will keep maintain their records on paper which will help to get the right information for paid or un-paid rent. In most of the states will specify the grace period, but sometime there is only 3-5 days for payment of rent after the due date. If you found that the tenant is really not paying the rent on time in records, then you can fine late payment charges if this clause is putted in the agreement.
Late Rent Notice
You get the renter in your homes for rent, is a good thing, but it is really bad when your tenant will not able to pay rent. The late rent notice, in this piece of paper landlord will remind the tenant that their past payments are still due. It includes all the payments that include late charges with warning that legal action will be taken if they will not pay the due full rent soon. It may be served to the tenants in person, email, or using tape to the door of the rental property from the due date. The late rent notice will also help you in court, that you are following all legal rules for collection of rent, it is necessary to take a copy of rent notice.
You should make a phone call to confirm that your renter is getting their late rent notice, maybe they will not answer your phone call you should keep trying to contact them or maybe make a visitor try to talk with them. As an alternate, you may email them, but this is not working, you keep trying to contact them and talk to them.
Pay or Quit Notice
This is highly official document than the late rent notice, it is the first step of the eviction process. It shows to the tenant that you are seriously taking action against the nonpayment of rent and tenant are still loathe to pay their rent with late charges after crossing the due dates. If you have the power of eviction attorney, it will make a draft & post it to the tenant's address. You may also mail them to your side as a backup, so that tenant will not neglect that they didn’t receive any legal notice like this. Now you have to wait for 3-5 days for the process, you may also check the local statues.
When nothing will work and tenant will still doesn’t pay your rent then you will take help from your lawn and take legal action. Now you can hire eviction lawyer, file a tenant-landlord complaint in court. You will need to pay fees and complete all the paperwork before you get the hearing date. When the day of the hearing of your case will come, you should know what to say and have all the evidence, documents will prepared.
